Notification

S.O. 1086 (E):- Whereas for the purpose of enabling the Central Government to fix or revise rates of wages in respect of journalists and non journalist newspaper and news agency employees, two Wage Boards were constituted under Section 9 and Section 13 C of the Working Journalists and Other Newspaper Employees (Conditions of Service) and Miscellaneous Provisions Act, 1955 (45 of 1955) on the 2nd day of September, 1994 by the notification of the Government of India in the Ministry of Labour numbers S.O. 64 (E), dated the 2nd September, 1994 and 642 (E), dated the 2nd September, 1994;

And Whereas the said Wage Boards submitted their recommendations to the Central Government on the 25th day of July 2000;

And Whereas, the Central Government proposes to accept the recommendations of the said Wage Boards contained in "Part Three" of the Report appended to the notification, subject to modifications hereinafter specified, being modifications which, in the opinion of the Central Government do not effect important alterations in the character of the recommendations;

Now, therefore, in exercise of the powers conferred by Section 12 of the Working Journalists and other Newspaper Employees (conditions of Service) and Miscellaneous Provisions Act 1955 (45 of 1955), the Central Government hereby orders that:

I. In Part Three, in Chapter I of the Recommendations of the Wage Boards for working journalists and non journalist newspaper employees (other than newspaper employees in news agency):-

(a) in Paragraph 9, for sub-paragraph (2), the following sub-paragraph  shall be substituted namely:-
"2) Wages of part-time Correspondent and Photographer shall be paid not less than fifty per cent of the basic pay plus dearness allowance applicable to a the full-time Correspondent and Photographer at similar level if he  is working at the District Headquarters and above subject to the condition that no part time Correspondent and Photographer shall work for more than two newspaper establishments. The wages shall not be less than one third if the Correspondent and Photographer is posted at a place below District level subject to the condition that he shall not work for more than three newspapers. In addition to it, payment of wages shall be on column basis, the rate of which may be decided by mutual negotiations.";

(b) in paragraph 12,-

(i) for sub-paragraph (2), the following sub-paragraph shall be substituted, namely:-
"(2) Dearness allowance may be sanctioned as soon as the figures for the quarter for which average All India Consumer Price Index is to be used for determining rate of dearness allowance becomes available. Dearness allowance will become payable from the beginning of the quarter immediately succeeding the quarter for which average All India Consumer Price Index figures are used for determining rate of dearness allowance.";

(ii) in sub-paragraph (3), the words "for regional centre" shall be omitted;

(c) in paragraph 21,-
(i) for the word "thirty", the word "eighteen" shall be substituted;
(ii) for the figures "10", the figure "6" shall be substituted;

(d) in 'THE FIRST SCHEDULE, in Group 3A, for the words "Proof Reader including Advertising Proof Reader and Planner", the words "Proof Reader including Advertising Proof Reader, Planner and Scanner Operator" shall be substituted;

(e) in THE SECOND SCHEDULE, in Group 3A, the following shall be inserted at the end, namely:- "Scanner/Scanner Operator means a person who scans the photograph/colour advertisements/illustrations and colour correction of photographs and transparencies.";

(f) in THE FOURTH SCHEDULE, in Group 1, the words "Scanner/Scanner Operator" shall be omitted;

(g) in Table 1, the following Note shall be added at the end, namely:-
"Note.- The rates of increment shall be the same for the same basic pay of journalists and non journalists having comparable basic pay.";

(h) for Table III, the following Table shall be substituted, namely:-

2. Between Rs. 5001/- and Rs. 7000/- 80% of basic pay or 100 per cent of Rs. 5000, whichever is higher
3. Between Rs. 7001/- and Rs. 9500/- 70% of basic pay or 80 per cent of Rs. 7000, whichever is higher
4. Between Rs. 9501/- to Rs. 12500/- 60% of basic pay or 70 per cent of Rs. 9500, whichever is higher
5. Above Rs. 12500 /- 50% of basic pay or 60 per cent of Rs. 12500, whichever is higher

 (i) in Table IV,  for the Note, the following Notes shall be substituted, namely:-
"Note I. The rates of house rent allowance mentioned above are subject to a maximum of rupees four thousand and five hundred per month for any group of employees under any class of newspaper establishments in any zone.

 Note II. The house rent allowance for class of newspaper establishments from VI to IX shall be fixed at the level as recommended by the Wage Boards or the one which the employee is drawing, whichever is higher,";

 (j) in Table VII, for the word "minimum", wherever it occur, the Word "actual" shall be substituted;

  II.     In Part Three, in Chapter 11 of the Recommendations of the Wage Boards for Working  Journalists and non Journalist newspaper employees in news agencies,-

(a)     in paragraph 8, for sub-paragraph (2), the following sub-paragraph shall  be substituted namely,-
"(2) Wages of part-time Correspondent and Photographer shall be paid not less than fifty  per cent of the basic pay plus dearness allowance applicable to a full-time Correspondent and Photographer at similar level if he is working at District Headquarters and above subject to the condition that no part time Correspondent and Photographer shall work for  more than two newspaper establishments. 'The wages shall not be less than one third if the Correspondent and Photographer is posted at a place below District level subject to the condition that he shall not work for more than 3 newspapers. In addition to it,  payment of wages shall be on column basis, the rate of which may be decided by mutual negotiations.";

(b)      in paragraph 11,-
(i)      for sub-paragraph (2), the following subparagraph shall be substituted, namely:-
         "(2) Dearness allowance maybe sanctioned -as soon as the figures for the quarter for
         which average All India Consumer Price Index is to be used for determining rate of
         dearness allowance becomes available. Dearness allowance will become payable from
         the beginning of the quarter immediately succeeding the quarter for which average All
         India Consumer Price Index figures are used for determining rate of dearness allowance.";
(ii)     in sub-paragraph (3), the words "for regional centre" shall be omitted;

(c)     in paragraph 19,-
(i)      for the word "thirty", the word "eighteen" shall be substituted;
(ii)     for the figures "10", the figure "6" shall be substituted;

(d     'in Table 1, the following Note shall be added at the end, namely:-
        "Note.- The rates of increment shall be the same for the same basic pay of journalists and.
         non journalists having comparable basic pay.";
